Prosecutors in former Letcher sheriff murder case reject request to dismiss indictment

Prosecutors filed papers opposing a request by the attorneys of former Letcher County Sheriff Mickey Stines' to dismiss his murder indictment.

Prosecutors in the murder case of former Letcher County Sheriff Mickey Stines have filed papers rejecting his attorney’s bid to dismiss the indictment.

The defense claimed Stines’ indictment for allegedly shooting Letcher District Judge Kevin Mullins to death last September was invalid because an October grand jury meeting wasn’t recorded. Prosecutors responded that the purpose of that meeting was to obtain Stines’ medical and jail records and no testimony was presented. Prosecutors also wrote that the grand jury was not misled about Stines’ mental health or his refusal to speak with investigators. They said that claim shows a misunderstanding of the differences between grand jury proceedings and criminal trials.
