AG Beshear Says Final Ruling on Higher Ed Funding Could be Months Away

Kentucky Attorney General Andy Beshear says it could be several months before a final state court ruling in his lawsuit against Governor Matt Bevin. 

Franklin Circuit Judge Thomas Wingate ruled Wednesday the governor had proper authority in ordering a two percent reduction in current year funding for public universities and colleges. 

Beshear says it’s a case that was always headed for the state’s highest court, "We will make a motion to move it directly to the Supreme Court, out of the Court of Appeals.  Our belief is that will be viewed favorably. It is a process.  But, we want to get to a final decision as quickly as possible."

Attorney General Beshear has argued the governor overstepped his authority in withholding funds without legislative approval and in the absence of a revenue shortfall.  A statement issued by the governor's office read, in part, "We are grateful for the court's prompt decision confirming our ability to manage the Commonwealth's finances in a fiscally responsible manner.” ?
