A same-sex couple that won a civil rights case against former Rowan County Clerk Kim Davis is asking a federal judge to hold her in contempt of court.
Davis garnered national attention in 2015 when she refused to issue marriage licenses to a same-sex couples because of her religious beliefs, shortly after the U.S. Supreme Court ruled to legalize same-sex marriage nationwide.
In 2023, a federal jury decided Davis owed $100,000 in damages to one of those couples, David Moore and David Ermold, after a ruling her refusals were unconstitutional.
Earlier this month, Moore and Ermold filed a lawsuit in Rowan Circuit Court, accusing Davis of hiding an inheritance to avoid paying $565,285.91 in awarded damages, attorneys' fees and court expenses.
It alleges Davis lied under oath about inheriting a share of property from her mother. Court records show she transferred her share to other family members in 2025.
Now, the couple is asking a federal judge to order Davis to show why she shouldn’t be held in contempt. They’re also asking sanctions for against Davis, which could lead to more fines.
“Plaintiffs are entitled to their expenses, including the time counsel expended uncovering the falsity and subsequent motion,” the motion reads.
They filed the motion in U.S. District Court in the Eastern District of Kentucky Tuesday evening.
