The former Rowan County clerk who refused to grant marriage licenses to same-sex couples has lost again in court. On Monday, the U.S. Sixth Circuit Court of Appeals denied Kim Davis’ motion to have her case heard again by the entire court. Lexington attorney Michael Gartland represents one of the couples she denied.
“Kim Davis has lost everything for eight years. Why would she be a winner now the Sixth Circuit's already decided this on a motion to dismiss, motion for summary judgment. This was no different.”
Davis is represented by Liberty Counsel, which pledged to ask the U.S. Supreme Court to review whether the First Amendment shields her from liability and damages for acting on her religious beliefs. Gartland said Davis never had a prayer in court – and still doesn’t.
“So she's down to one blank left in her gun. She'll file it at the Supreme Court, and this case will be over. When they say we're not hearing it, they've already denied it once in this case and once in a criminal case.”
Gartland said Davis turned his clients down three times and still owes them $360,000 in damages – plus interest.
