Amended adult-oriented business bill emerges from the Kentucky Senate

The Kentucky Senate has acted overwhelmingly to increase regulations relating to adult-oriented businesses. Approved amendments include one pertaining to drag shows.

The measure, sponsored by GOP Senator Lindsey Tichenor of Smithfield, was amended on the floor to remove the word “drag” from the definition of adult cabaret. Tichenor said this legislation wouldn’t prohibit all “drag shows”, for instance, in a public park.

“As long as it’s not sexually..sexual conduct…which is defined in the bill. That’s what this is specific to,” said Tichenor

Tichenor said in order to not single out “drag shows” specifically, it’s included in every other adult performance. The legislation also pertains to adult bookstores, adult arcades, or adult video stores in distance limitations to such things as daycares and schools.

Casting one of the "no" votes was Louisville Democratic Senator David Yates. He said there could be extensive litigation costs around First Amendment issues. Yates said this legislation is written more around zoning.

“And to me I think zoning can be a great strong control for local control…what you know is best for you. And to me I think we should allow that local control and the local zoning…which is my worry is that how that we do this at the state level.” Said Yates.

The bill now heads to the House.
